2. Definitions

• "Rider": a user who books or takes rides via PHYEV.

• "Driver": a verified partner providing rides through PHYEV.

• "Fare": the amount paid for a ride, computed under our Dynamic Distance Time Pricing Model (DDTPM), excluding tolls or taxes.

3. Eligibility

You must be at least 18 years old and provide accurate registration details including identity proof, mobile number, and payment information.

Drivers must meet our verification criteria, including valid license, vehicle registration, and insurance documentation.

4. Account Registration & Use

• Your account must be secure. You're responsible for safeguarding your credentials and activities.

• You agree to update your information promptly to maintain accuracy.

5. Booking & Cancellations

• You may request Instant, Scheduled, or Outstation rides.

• Cancellation policies and associated fees, if any, are detailed in-app at booking or cancellation time.

• PHYEV reserves the right to refuse service or cancel rides for safety, technical malfunctions, or policy violations.

6. Pricing & Payment

• Fares are calculated transparently via our DDTPM, with no surge pricing or hidden commissions.

• Payment options may include UPI, digital wallet, debit card, or cash. Riders will see the total fare before confirming.

• Drivers receive settlements typically same-day with disbursements per the service schedule.

7. Referral Program

Eligibility, payout terms, and compliance requirements are governed by separate referral documentation.

8. User Conduct & Prohibited Uses

You agree to:

• Respect privacy and safety during rides.

• Refrain from illegal, dangerous or harassing behavior.

• Use the Services fairly and not manipulate pricing or referral systems.

Violation may lead to account suspension or permanent ban.

9. Intellectual Property

All logos, designs, text, and features in the app or site are owned or licensed by PHYEV. You may not use, reproduce, or distribute any content without our express written permission.

10. Limitation of Liability

PHYEV disclaims liability for direct, indirect, incidental, or consequential damages arising from:

• Use or inability to use the Services.

• Unauthorized access or system failure.

• Third‑party content or conduct.

To the extent permitted by law, our total liability is capped at the total fees paid by you to PHYEV in the preceding six months.

11. Indemnification

You (and any authorized user of your account) agree to indemnify PHYEV and its affiliates, directors, employees, and agents from claims arising from:

• Breach of these Terms.

• Misuse of the Services.

• Violations of law or third-party rights.

12. Disputes, Governing Law & Jurisdiction

• These Terms are governed by Indian law.

• Any disputes will be resolved exclusively in Bangalore courts.

13. Termination

• You may terminate your account with prior notice per in-app procedure.

• PHYEV reserves the right to suspend or terminate your access for any breach, with or without notice.

14. Policy Changes

We may update these Terms as our Services evolve. Changes will be posted with an updated "Last Updated" date. Continued use after updates implies acceptance.

15. Severability

If any provision is invalid under applicable law, it does not affect the validity of other provisions.
